Who we are
Northfin Ltd, trading as Daycount (company number 15923969, registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ), is the controller of the personal information described here. ICO registration: applied for. Contact us about privacy at enquiries@daycount.co.uk.
Whose information we hold
We mostly deal with businesses. We hold personal information about: sole traders and partners who are customers of companies whose claims we have bought; contact people at customer businesses; insolvency practitioners and their staff; and anyone who contacts us or pays us.
What we hold and where it comes from
- From the insolvent company's records (provided by its liquidator): customer names and addresses, invoice and payment records, and contact details held for the account.
- From public registers: The Gazette and Companies House, for example company status and the names of insolvency practitioners.
- From you: what you tell us when you contact us, dispute a claim or pay, including payment references.
Why we use it, and our lawful basis
- To evaluate whether to buy claims from a liquidator: legitimate interests.
- To notify you of the assignment, calculate, collect and, if necessary, enforce the claims, including handling disputes: legitimate interests, and the establishment, exercise or defence of legal claims.
- To take and refund payments and keep accounts: legal obligation (accounting and tax records) and legitimate interests.
- To answer questions and complaints: legitimate interests.
We do not sell personal information, use it for marketing to you, or make decisions about you by automated means alone. A person reviews every dispute and every decision to take further steps.
Who we share it with
Our payment provider, our IT and email providers, our professional advisers, the liquidator of the company concerned, and courts or regulators where required by law. Our providers act on our instructions under written terms.
Your online statement
If we write to you about a claim, you can see your statement on this website using the access code in your letter. The statement holds the same information as the letter. It is stored encrypted, we do not keep the code on the website's server, and the page uses no cookies. We record when a statement was viewed, but not who viewed it or from where. Temporary records of failed code attempts, used to block abuse, are held in memory only and never saved. We delete the statement from the website 30 days after the matter closes.
How long we keep it
If we do not buy the claims, we delete the data we received within 90 days. If we do, we keep claim and payment records for six years after the claim is closed, to meet accounting obligations and in case of legal claims, and then delete them.
Your rights
You can ask for a copy of your information, ask us to correct it, object to how we use it, or ask us to restrict or delete it where the law allows. Contact enquiries@daycount.co.uk. If you are unhappy with how we have handled your information, you can complain to the Information Commissioner's Office (ico.org.uk, 0303 123 1113).
Security
We keep records on encrypted, access-controlled systems with encrypted backups, and limit access to people who need it.
